LANSING, MI (WKZO AM/FM) – Michigan Attorney General Dana Nessel has filed a public enforcement lawsuit against Climax Solar, owner Joshua Thompson, and the financial institutions that financed people’s purchases of the systems.
Climax Solar was based in Portage and filed for bankruptcy and closed in 2024.
The federal complaint alleged the defendants participated in a deceptive financing scheme that impacted roughly 1,700 Michigan consumers and involved $81-million in financed transactions of in-home sales.
Nessel says the scheme violates the federal Consumer Fraud Protection Act, the Michigan Consumer Protection Act, and the Michigan Home Solicitation Sales Act.
It’s also alleged Climax Solar committed common-law fraud and unjust enrichment.
The lawsuit is seeking to stop the alleged unfair, deceptive, and abusive practices in residential solar sales and seller-arranged financing.
Some finance companies continued to treat the debt homeowners had as valid and collectible, even though Climax was no longer available to provide repairs or complete installations.
